Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the KaiFit AI mobile application (“App”) and the services (“Services”) provided by MaxAI, Inc. (“we”, “us”, or “our”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, you must immediately cease use of the App.

1. Eligibility & Account Registration

• You must be at least 18 years old to create an account and use the App.
• You agree to provide complete, accurate, and up-to-date information when registering and to update this information as needed.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

2. Subscriptions, Billing & Free Trial

• The App offers auto-renewing monthly and annual subscriptions purchased via the App Store or Google Play (“Subscription”). A free trial may be offered before the Subscription begins.
• Your Subscription will auto-renew at the end of each term unless cancelled in accordance with the App Store/Google Play process.
• All purchases are final. No refunds will be provided for any used or unused portion of a Subscription.
• Billing and renewal reminders are handled by Apple or Google and subject to their terms.

3. Modification, Termination & Suspension

• We may modify, suspend, or terminate your access to the App or Services at any time, without notice or liability, for any reason including violation of these Terms.
• Upon termination, your right to use the Services ceases immediately.
• You may delete your account and associated data through the in-app functionality.

4. Use of the App & Restrictions

• The Services are provided solely for your personal, non-commercial use.
• You may not reverse engineer, decompile, disassemble, scrape, extract data, create derivative works or otherwise attempt to derive the source code of the App.
• Unauthorized use, data harvesting, bots, or automated access are strictly prohibited.

5. User-Generated Content

• You may submit logs, entries, data or other content (“User Content”). You retain ownership of your User Content but grant us a worldwide, nonexclusive, royalty-free, sublicensable license to use, reproduce, adapt, host, store and display such content in connection with operating the App.
• We do not guarantee the accuracy, integrity or use of any User Content.

6. Disclaimer of Medical Advice

• The App provides general nutritional and fitness insights and should not be construed as medical advice. Always consult a qualified healthcare professional before starting any program.

7. Limitation of Liability

• To the fullest extent permitted by applicable law, MaxAI, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits or data, arising out of or related to your use of the App or Services.
• In jurisdictions where such limitations are not permitted, liability shall be limited to the maximum extent permitted by law.
• Some nutrition information, meal suggestions, food attributes (including but not limited to calories, macronutrients, dietary classifications such as halal, kosher, vegan, Jain, etc.), and restaurant recommendations are generated by artificial intelligence and/or third‑party data sources. We do not warrant the accuracy, completeness, or safety of such information. Users must independently verify all food suitability with restaurants or qualified sources before consumption. MaxAI, Inc. is not liable for any harm, injury, or damages resulting from reliance on such information.

8. Governing Law & Dispute Resolution

• These Terms are governed by the laws of the Commonwealth of Virginia, U.S.A., excluding its conflict of law principles.
• If you are a resident of the European Union, you will also benefit from mandatory consumer protections where applicable.

9. Changes to Terms

• We reserve the right to change or update these Terms at any time. If a material change is made, we will provide notice (e.g., via the App or email) at least 30 days prior to the change becoming effective.
• Continued use of the Services after the effective date constitutes acceptance of the updated Terms.

10. Third‑Party Attribution
